Citizen Services supports RA 10361: the “Domestic Workers Act” or “Batas Kasambahay”.

The new legislation entitles domestic workers to benefits such as a set minimum wage, work leaves with pay, and enrollment in insurance programs such as the Social Security System (SSS), the Philippine Health Insurance Corporation (PhilHealth), and the Home Development Mutual Fund or Pag-IBIG, and shall be entitled to all the benefits in accordance with the pertinent provisions provided by law.

PRE-EMPLOYMENT
SEC. 11. Employment Contract. – An employment contract shall be executed by and between the domestic worker and the employer before the commencement of the service in a language or dialect understood by both the domestic worker and the employer. There are various requirements when entering into an employment contract as stated by law. However, one of the most crucial in determining the identity of a person is his/her birth certificate. ARTICLE IV


EMPLOYMENT – TERMS AND CONDITIONS
SEC. 30. Social and Other Benefits. – A domestic worker who has rendered at least one (1) month of service shall be covered by the Social Security System (SSS), the Philippine Health Insurance Corporation (PhilHealth), and the Home Development Mutual Fund or Pag-IBIG, and shall be entitled to all the benefits in accordance with the pertinent provisions provided by law.
Premium payments or contributions shall be shouldered by the employer. However, if the domestic worker is receiving a wage of Five thousand pesos (P5,000.00) and above per month, the domestic worker shall pay the proportionate share in the premium payments or contributions, as provided by law. The domestic worker shall be entitled to all other benefits under existing laws.

Step 2: Apply for SSS membership

Applying for SSS membership can be done onsite at any SSS branch near you.

Application of membership is done for both employee and the employer.

Step 3: Apply for PHILHEALTH membership

Go to your nearest Philhealth office to apply for your membership.

Memberships are for both kasambahay and for the employer.

Step 4: Apply for Pag-Ibig membership

Visit your nearest Pag-Ibig branch to apply.

Both kasambahay and employer need to apply for their membership numbers.
